NOTICE IS HEREBY GIVEN that the undersigned Trustee, Rainier Trustee Services, Inc., will on DECEMBER 27, 2024, at the hour of 10:00 a.m., outside the Front entrance of the Chelan County Court- house, 401 Washington Street, in the City of Wenatchee, State of Washington 98807-3025, sell at public auction to the highest and best bidder, payable at the time of sale, the following described real property (the “Real Property”), situated in the County of Chelan, State of Wash- ington, to wit: Lot B, as descried in and delineated on OHRT Short Plat No. 741, re- corded April 15, 1981, under Chlan County, Washington Auditor’s fil No. 823773, being a portion of Lot 101, High Line Division No. 3 of the Lake Chelan Land Company’s Irrigated Lands, according to the Plat thereof recorded in Volume 3 of Plats, Page 14, Chelan County, Wash- ington. (Tax Parcel No. 282136608441) The postal address of which is more commonly known as: 51 Bay View Lane, Manson WA 98831 The aforesaid Real Property is subject to that certain Deed of Trust (the “Deed of Trust”), and the present Beneficiary described below has declared a default on the obligations secured by the Deed of Trust dated July 17, 2020, recorded on July 22, 2020, under Chelan County Recorder’s File No. 2520480, records of Chelan County, Washington. The Deed of Trust was granted by Eastern WA Construction Inc., a Washington corporation, the Grantor (“Grantor” or “Borrower”), to First American Title Insurance Company, as the original Trustee, for the ben- efit of Tamaris Properties LLC, a Washington limited liability company, the original beneficiary of the Deed of Trust (the “Original Beneficiary”). The beneficial interest in the Deed of Trust was assigned by the Original Beneficiary to Tamaris & Associates, Inc., Washington corporation, the present Beneficiary and the present holder of the obligations secured by the Deed of Trust, pursuant to an Assignment of Deed of Trust dat- ed September 11, 2023, and recorded on September 12, 2023, under Chelan County Recorder’s File No. 2586121, records of Chelan County, Washington. The Beneficiary is the current owner and holder of the Note secured by the Deed of Trust. Pursuant to the Deed of Trust, the Beneficiary is additionally the holder of a security interest in certain personal property and other property (collectively the “Additional Property”) described on Exhibit A, attached hereto and incorporated herein by this reference. The Real Property and the Additional Property shall hereinafter be collectively referred to as the “Property.” II. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligations secured by the Deed of Trust in any Court by reason of the Borrower's or Grantor's default on the obligations secured by the Deed of Trust. III. The defaults for which this foreclosure is made are as follows: Failure to pay when due the following amounts which are now in arrears: a: Failure to pay the following past due amounts, which are due in full: Principal: $443,732.74* Accrued Interest from 03/04/2020, Through and Including 09/16/2024, at the rate of 12% per annum: $255,576.24** Loan Fee: $ 18,968.00 Appraisal Fees: $ 1,300.00 Delinquent Real Estate Taxes Paid by Beneficiary: $ 4,040.04 Beneficiary’s Protective Advances: $119,182.11 Pre-Foreclosure Attorney’s Fees and Costs: $ 5,217.00 Reconveyance Fees: $ 600.00 TOTAL: $848,616.13 *The Promissory Note (the “Note”) secured by the Deed of Trust atured on July 2, 2021, on which date all amounts owing under the Note be- came immediately due and payable. **Interest continues to accrue on the outstanding principal of the Note at the default interest rate of 12% per annum and $145.88 per day. The sums owing on the obligations secured by the Deed of Trust are: Principal: $443,732.74, together with unpaid accrued interest (including default interest) as provided under the Note or other instrument secured as referenced above from March 4, 2020, MERGEFIELD MoYrIFD and together with such other advances, costs and fees as are due under the Note or other instrument secured and as are provided by statute. V. The above-described Property will be sold to satisfy the expense of sale and the obligations secured by said Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, re- garding title, possession, or encumbrances on DECEMBER 27, 2024. The defaults referred to in Paragraph III must be cured by DECEMBER 16, 2024 (11 days before the sale date), to cause a discontinuance of the sale. VII. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it, a statement of all costs and fees due at any time prior to the sale. VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above- described Property. IX. Anyone having any objections to this sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections, if they bring a lawsuit to restrain the sale, pursuant to R.C.W. 61.24.130. Fail- ure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee's Sale. X. NOTICE TO OCCUPANTS OR TENANTS The purchaser at the trustee's sale is entitled to possession of the Property on the 20th day following the sale, as against the Grantor under the Deed of Trust (the owner) and anyone having an inter- est junior to the Deed of Trust, including occupants who are not tenants. After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary pro- ceedings under chapter 59.12. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060. XI. NOTICE TO GUARANTORS: Any guarantor of the obligations secured by the Deed of Trust may be liable for a deficiency judgment to the extent the sale price ob- tained at the trustee’s sale is less than the debt secured by the Deed of Trust. All guarantors have the same rights to reinstate the debt, cure the default or repay the debt as is given to the Grantor and Borrower in order to avoid the trustee’s sale. Any guarantor will have no right to redeem the Property after the trustee’s sale. Subject to such longer periods as are provided in the Washing- ton Deeds of Trust Act, Chapter 61.24 RCW, any action brought to enforce a guaranty must be commenced within one year after the trustee’s sale, or the last trustee’s sale under any deed of trust granted to secure the same debt. In any action for a deficiency, a guarantor will have the right to establish the fair value of the Prop- erty as of the date of the trustee’s sale, less prior liens and encum- brances, and to limit the guarantor’s liability for a deficiency to the difference between the debt and the greater of such fair value or the sale price paid at the trustee’s sale, plus interests and costs.
