CITY OF CHELAN NOTICE OF DECISION February 7, 2024 NOTICE IS HEREBY GIVEN that on January 29, 2024, the City of Chelan Hearing Examiner rendered the following decision following the public hearing conducted on January 18, 2024: CUP2023-15/SSDP2023-03/SEPA2023-074 are hereby APPROVED in part, subject to the Conditions of Approval. The request for home stay units and a pool and spa are hereby DENIED. A copy of the Hearing Examiner’s decision is available upon request at City Hall. Project Description: An application for a Conditional Use Permit (CUP2023-15) for high intensity agricultural tourism use, to operate a winery, including vineyards, wine production and tasting room; associated 20 homestay units (10 separate structures) with guest pool and spa facilities; and short-term events for up to 120 people. 129 new parking stalls will be added to accommodate the uses onsite. Also included is a request for a shoreline substantial development permit (SSDP2023-03) to construct a new internal private road to serve the project, located within shoreline jurisdiction and the Purtteman Gulch Creek buffer. The existing connection onto SR 150 will be relocated to provide improved sight distance in compliance with DOT requirements. Proposed mitigation includes 7,821 sq ft of native vegetation plantings between the road and the creek, and soil remediation in accordance with Ecology’s Model Remedies for Cleanup of Former Orchard Properties. Project Applicant: Tim McDonald, Bluewater Legacy Estates & RLK Legacy LLC, 1533 Lakeview St, Entiat, WA 98822 Environmental Review: On December 6, 2023, the City of Chelan issued a SEPA Determination of Nonsignificance (DNS) under WAC 197-11-340(2) with a comment period through December 20, 2023. A copy of the threshold determination may be obtained upon request or at: https://tinyurl.com/City-of-Chelan-SEPA-Register. Pursuant to RCW 90.58.180, anyone aggrieved by the decision for SSDP2023-03 may seek review from the Shorelines Hearings Board by filing a petition for review within twenty-one days of the “date of filing” of the decision as defined in RCW 90.58.140(6). Anyone aggrieved by the decision for CUP2023-15 has twenty-one (21) days from the issuance of this decision, to file an appeal with Chelan County Superior Court, as provided for under the Judicial Review of Land Use Decisions, RCW 36.70C.040(3). The date of issuance is defined by RCW 36.70C.040 (4)(a) as "(t)hree days after a written decision is mailed by the local jurisdiction or if not mailed, the date on which the local jurisdiction provides notice that a written decision is publicly available" or if this section does not apply, then pursuant to RCW 36.70C.040(3) (c)" ... the date the decision is entered into the public record."
